Section 1: Lots and Burials

• 1.1 All the lots in the Willow Glen Cemetery are sold in accordance with the provisions of the laws of the State of New York and shall not be used for any other purposes than as a burial place for deceased human beings.  Cremated remains may not be scattered on cemetery property.
• 1.2 A lot shall consist of not less than two graves side by side. A grave is a place in a lot for the burial of not more than two human remains.
• 1.3 No interment shall be allowed without permission being first obtained from the Willow Glen Cemetery Association.  At the time of applying for permission for interment, an interment data sheet must be provided to the cemetery.
• 1.4 There will be no burials on Sundays or holidays.
• 1.5 The full purchase price must be paid before a deed will be given or burial allowed.
• 1.6 All funerals, processions and vehicles will be under the control of the superintendent while in the cemetery and must arrive at the cemetery by 3:30 p.m. in order that the workers will have sufficient time to properly close the grave and remove equipment before 5:00 p.m.
• 1.7 Graves will not be opened when frost and weather conditions warrant such refusal. Bodies received for interment during this time will be placed in the receiving vault until the cemetery opens in the spring. Only embalmed bodies, encased in a rigid, leak proof casket with appropriate handles will be allowed in the receiving vault.
• 1.8 All bodies left in the vault after June 1 will be removed and interred. If not entitled to burial in a family plot, they will be interred in a single grave.  The expense of such interment shall be borne by those who caused the body to be placed in the receiving vault.  Only such notice shall be given in this case as shall be practical under the circumstances.
• 1.9 In accordance with the provisions of Cemetery Board Directive 201.6 concrete vaults or concrete grave liners manufactured for the purpose of burial are required for all casketed burials to be made on lots purchased after January 1, 2003.
• 1.10 Cremated remains will not be permitted to be scattered in any part of the cemetery. The interment of cremated remains will be permitted only in appropriate rigid receptacles such as wood, metal, plastic or concrete.
• 1.11 Only two human remains will be permitted in each grave. This may include any combination of casketed and cremated remains.  In specially designated areas where cremation graves are sold there shall not be more than two cremated remains and one flush marker per grave.

1.12 Lot owners are prohibited from allowing interments to be made on their lots for compensation.

1.13 Interments in a lot are restricted to those entitled to burial therein according to the terms of Section 1512 of the Not-For-Profit Corporation Law.  Permission for burial of those not entitled to burial according to the said Section, must be filed with Willow Glen Cemetery Association by the lot owner(s).

1.14 Except as provided for in Section 1513(c) of the Not-For-profit Corporation Law, no lot owner may transfer his or her lot.

1.15 Disinterments will be allowed provided the provisions of section 1510 (e) of the Not-for-profit Corporation Law are complied with.

1.16 Interest of deceased lot owner: Upon the death of an owner or co-owner of any lot, plot or part thereof, unless the same shall be held in joint tenancy, or by tenancy by the entirety, the interest of the deceased lot owner shall pass to the devises of such lot owner, but, if such interest be not effectually devised, then to his or her descendants then surviving, and if there be none, then to the surviving spouse, and if there be none, then to those entitled to take the real and personal property of the deceased lot owner pursuant to article four of the estates, powers and trust law provided, however, that no interest in any lot, plot or part thereof shall pass by any residuary or other general clause in a will and such interest shall pass by will only if the lot, plot or part thereof sought to be devised is specifically referred to in such will.  The surviving spouse of a deceased lot owner during his or her life and the owners from time to time of the deceased lot owner’s lot, plot or part thereof, shall have in common the possession, care and control of such lot, plot or part thereof.

Section 2: Policy for Winter Burials in Willow Glen Cemetery

• 2.1 When ice, snow, extreme cold or soft ground conditions exist the caretaker or his representative, together with the President and Vice President, may designate any burial in the cemetery between the dates of November 1 and April 15 of each year as a Winter Burial.
• 2.1 Casketed remains or urns of cremated remains may be stored at no charge in the receiving vault until burial can be made in the spring according to the existing rules of the cemetery.   The following policy will apply if burial must be made between November 1st and April 30th and the cemetery representatives (mentioned above) cause the burial to be designated as a Winter Burial.
• 2.2 Families who insist on a winter burial must consult with the cemetery before scheduling the day and time of burial.
• 2.3 If necessary, the cemetery will engage a contractor to perform all the necessary tasks associated with opening and closing the grave including plowing roads, moving markers and monuments, clearing the burial plot, thawing ground, and restoration work in the spring.  
• 2.4 All charges for such work will be the responsibility of the person ordering the burial.
• 2.5 Persons requesting a winter burial should be advised that estimates from a local contractor are as high as $2000.00 for casketed remains and $1000.00 for cremated remains.   These special charges are in addition to all other standard fees as filed with the New York State Cemetery Board and must be paid prior to the interment. In cases where a burial plot must be purchased and there is snow cover, the representative of the deceased shall select the site from the cemetery master map and the exact location will be determined when the area is cleared of snow.  

Section 3:  Monuments, Markers and Foundations

• 3.1 Important Notice: Monument Restrictions apply throughout the Willow Glen Cemetery
• 3.2 All work done in the cemetery shall be done by cemetery employees and be under the control of and with the permission of the superintendent and/or board of directors.
• 3.3 No vault, mausoleum, columbarium or any structure for above ground casket interment or placement of cremated remains in an above ground niche shall be installed without the permission of the board of directors and then only in such location as they may approve.
• 3.4 No monuments or markers shall be permitted which utilize colors other than those of natural stone.  All monuments or markers must be constructed of granite or bronze.
• 3.5 All foundations will be constructed by or under the direction of the Willow Glen Cemetery Association and then only after receipt of payment from the lot owner or their representative. An approved memorial installation application is required before any work is begun.
• 3.6 Only one upright monument shall be allowed on a lot and it shall be set in accordance with the general plan of the cemetery and shall conform to said plans in size and material.
• 3.7 Monuments and monument base stones are restricted to not exceed 80% of the width of the lot and to be not more than 14 inches from front to back.  In all cases monuments are subject to the approval of the superintendent of the cemetery.
• 3.8 The base of all monuments shall be finished true and level.
• 3.9 Heavy trucking or other vehicular traffic shall be refused entrance to the cemetery when, in the opinion of the superintendent, injury to roads and driveways might result.
• 3.10 Placing of glass blocks or glass vases on graves or lots are prohibited and are not allowed as receptacles for artificial or grown flowers.
• 3.11 No artificial flowers may be placed in the cemetery between April 1st and October 15th.
• 3.12 All persons shall be allowed access to the cemetery during daylight hours, observing the rules which are in effect and the propriety due the cemetery.
• 3.13 No one will be allowed access by vehicles during winter months when chains are across the entrances.

Section 4: Grave Decorations Policy

• 4.1 The Willow Glen Cemetery Association reserves the right to remove, after due notice to the lot owner, any embellishment on the lot, effigy or inscription which, in the opinion of the majority of the trustees or directors, is unsightly or dangerous.
• 4.2 The Willow Glen Cemetery Association reserves the right to restrict the planting of shrubs and trees and to remove any shrub or tree deemed to be dangerous to the public or encroaching upon adjacent lots upon due notice to the lot owner.
• 4.3 Flower bed edging or borders of brick, concrete, stone, plastic, wood, wire or other materials are not allowed.  
• 4.4 In ground planting is allowed only behind borders provided by the cemetery (for an installation fee).  If a lot decoration/flower bed is unattended the border will be removed by the cemetery and the area seeded to grass.   Stones and or decorative stones of any size are not to be substituted for mulch.
• 4.5 Lot owners of two or more adjacent graves may decorate each standing monument with two flower urns, or flower pots which must be placed at the end(s) of the monument or marker.  Such decorations may be in place from April to October 15th.   Additionally, one small statue or similar memorial and one flame or light, all not to exceed 24 inches in height, will be permitted for each burial.  To prevent winter damage and breakage flower urns and decorations must be removed from the cemetery by the lot owner each year by October 15th.
• 4.6 Lot owners may substitute one suitable and properly erected “Shepherd Hook” and hanging flower pot for a flower urn.  One “Shepherd’s Hook” will be allowed per lot regardless of the number of graves in the lot.  On single grave lots only one flower pot is allowed and must be placed beside the marker.  Shepherd’s Hooks are not allowed on single graves.
• 4.7 Glass, ceramic, breakable objects, objects on wire or wire devices are not allowed at any time.  
• 4.8 Artificial flowers may be placed after October 15th and must be removed by April 1st
• 4.9 The caretaker or his/her representative may remove any decorations and planting which do not conform to these rules or are deemed inappropriate, disrespectful or remain unattended and poorly maintained.
• 4.10 Monument foundations must not exceed the monument length and width by more than 3 inches and shall not be more than inches front to back so as to accommodate the monument and provide a 3 inch foundation border.
